If you do not agree with any part of our Terms & Conditions of Use, we advise you to abstain from using our website services. Modifications made to our Terms & Conditions of Use after the placement of an order do not apply to any transactions concerning this order, unless implemented by law. This website is available for personal use only. Any commercial use of this website is strictly prohibited. The Terms & Conditions of Use of this website bind any transactions made through this website and are in full compliance to the mandatory statutory or regulatory provisions of the Greek Law. Ordering Methods

You can place your order in the following ways:

• Through our www.ikastikos-kiklos.com website, 24 hours per day, 7 days per week.
• Via e-mail to info@ikastikos-kiklos.com .
• By calling us at 210 3648335 (Tuesday-Thursday-Friday: 10.00-20.00, Wednesday: 10.00-15.00, Saturday: 10.00-16.00).

You will always receive an order confirmation via e-mail. You can cancel your order within three (3) hours, via e-mail or by phone.

Registration is optional and it provides full access to our website’s abilities.

Upon placing your order, you will be required to sign in our website by filling in our Entry Form with your personal information, such as your real name and surname, phone number (mobile or landline), e-mail address etc. Upon completing your purchase, you represent and warrant that the provided payment details are correct and valid, ensuring payment approval after your order has been accepted and processed.

Upon placing an order, you guarantee the ownership and validity of your billing details. If you are a minor (a person under 18 years old), you should not create a user’s account or register any personal information on this website. The use of this e-shop is strictly prohibited to all minors and persons lacking legal capacity.

This website’s e-shop is available to persons who:

• have agreed to the website’s Terms & Conditions of Use.
• have registered a valid debit/credit card acceptable to our website, or have agreed to deposit the total purchase amount to our company’s bank account.
• have authorized the Company to process a charge on their debit or credit card equal to the amount of the total purchase price for the ordered items.

The creation of a User’s Account provides you with:

• a full history of your purchases.
• the safekeeping of your profile’s registered data which will automatically appear on the necessary forms every time you wish to proceed to a new purchase.
• the addition of items in your ‘Wishlist’ for future purchases.

The ‘Log in/Register’ button is always located on the top right corner of all of our website’s pages. Mobile/tablet users can find the ‘Log in/Register’ button in the ‘burger’ menu, on the top right corner of their screen. By clicking on this button you can access the ‘Log in/Register Page’. Fill in your personal data (e-mail and password of at least four (4) characters) in the right column, under the title ‘Register’. The registration process will be automatically completed upon clicking on the ‘Register’ button.

Your Personal Account page offers you the following options:

• Control Panel – where you can enter or edit your shipping/billing address.
• Profile – where you can edit your personal data and password.
• Orders – where you can review your order history.
• Wishlist – where you can revisit your favorite items.
• Shopping Cart – where you can review your Shopping Cart.

Ordering and Purchase

All orders are subject to availability. All items contained in your Shopping Cart are not reserved, being at the disposal of other users until your purchase is completed. To conclude your order, please visit your ‘Shopping Cart’ page. Your Shopping Cart contains all your selected items. You can delete items by clicking on the ‘Delete’ button, or adjust the desired quantity by clicking on the indicative arrows. These actions will take effect only after you click on the ‘Refresh’ button.

When you have decided on your order, please select the delivery method of your preference in order to be informed of any additional delivery costs. You may then click on the ‘Proceed to Payment’ button, entering the ‘Purchase’ page where you can review the ‘Billing Information Form’. Should the billing address be any different from the shipping address, please fill in the required data in the ‘Shipping Information Form’. Shipping information is mandatory, whether you choose to pick up your order from the store or not. You will have the opportunity to make your final choice of delivery method at the ‘Your Order’ page. You can make your selection among the following delivery options:

• Pick up your order from our store (during opening hours)
• Courier delivery: extra charge of 7.00 Euros (estimated delivery time: 7-10 business days)
• Free shipment: available only on orders over 130 euros (estimated delivery time: 7-10 business days)

You can complete your purchase in the following payment methods:

You can pay at www.ikastikos-kiklos.com  using your Visa, Master, Maestro or American Express debit or credit card.

In case one (or more) of your selected items is not immediately available, the corresponding amount of money will be returned to your card after our personal communication.

After depositing the full amount of your purchase to our Company’s Alpha Bank account (as mentioned above), please notify us in one of the following ways:

(The depositor’s full name must be indicated on the depositary receipt).

1. Cash upon delivery (this transaction bears a 2.00 Euros additional charge per shipment)

We would like you to know that your order will be processed and executed only after the Company has been notified of your deposit in one of the above described methods.

Upon the completion of your purchase, you will receive a confirmation e-mail containing the details of your order.

The Company reserves the right to cancel any order in case:

• we do not receive a payment authorization
• we cannot deliver your order to the designated address
• you have not agreed to our site’s Terms & Conditions of Use

If you wish to cancel your order, you must notify us within three (3) hours from its placement.  In case your purchase has been completed via credit/debit card or a bank account deposit, we will contact you via e-mail or by phone to inform you of the reimbursement, using the same means of payment as you used for the initial transaction. In case your order indicates a different payment method, you will be only notified of your order cancelation.

If you wish to pick up your order from our store, please note that you must do so within 10 days of its placement.

If you wish to pay by Cash on Delivery, please note that you are obliged to accept the delivery of the product, otherwise your order will be canceled and you will be charged with the full delivery costs.

The Company reserves the right to verify your personal information any deny you any future services should you proceed to more than two cancelations.

Payment Policy

All transactions performed through the ‘Ikastikos Kiklos Sianti’ e-shop are carried out in Euros. If your card or bank account is denominated in a different currency, the final price will be calculated in accordance with the applicable exchange rates.

Delivery costs are borne by the customers upon purchase.

If you choose ‘Delivery by ACS Courier’ you will be presented with the following options:

• CREDIT/DEBIT CARD (you will be automatically redirected to the secured environment of the Alpha Bank web banking, where you will be asked to fill in your debit/credit card information)
• CASH ON DELIVERY (this option has an additional charge of 2.00 Euros per shipment)
• PAY PAL PAYMENT (you will be automatically redirected to the secured PayPal environment)

• The Company reserves the right to adjust prices without further notice.
• All prices in our website are 24% VAT inclusive.

Applicable Law and Jurisdiction – Dispute Resolution

The above mentioned Terms & Conditions of Use and the policies concerning any transactions made through our website are governed and construed by the current legislation on Electronic Commerce and Distance Sales, in accordance with the Greek and the EU law as applicable through the provisions of Law No. 2251/1994 on Consumer Protection, the EU Directive 2011/83/EU on Consumer Rights (under its national implementation by the Joint Ministerial Decision 70330/2015 and Law No. 2472/1997 on the Protection of Individuals and Personal Data) as well as the European Parliament and Council Directive 2002/58/EU on the Processing of Personal Data and the Protection of Privacy in the Electronic Communications Sector, as amended by the Directive 2009/136/EU.

Any dispute arising from the contractual relationship between the Customer and the ‘Ikastikos Kiklos Sianti’ Company shall be subject to the exclusive jurisdiction of the material competent Courts of Athens, Greece.

For the extra-judicial resolution of occurring disputes, the Customer may address the competent authorities of:

• the General Secretariat of Consumer Affairs of the Hellenic Ministry of Development and Competiveness (Kanigos Square, Athens 10181, www.efpolis.gr/, T: 1520, Fax: 2103843549)
• the Hellenic Consumer’s Ombudsman (http://www.synigoroskatanaloti.gr/, 144, Alexandras Av., Athens 11471, T: 210 6460734, Fax: 210 6460414)
• the Commissions of Amicable Settlements for Consumer Disputes (Law 2251/1994, article 11) which fall under municipal jurisdiction.

The Joint Ministerial Decision 70330/2015, in line with Directive 2013/11/EU, provides for the electronic resolution of consumer disputes among EU countries through the ‘Alternative Dispute Resolution’ legislation. If a Customer is dissatisfied with a purchase performed through the Company’s e-shop and he/she is a resident of an EU country, he/she may refer to https://webgate.ec.europa.eu/ord/main/?event=main.home.show for the extra-judicial resolution of the dispute.

The certified authority is the Alternative Dispute Resolution Body (ADR), 144 Alexandras Avenue, Athens 11471, T: 210 6460284 & 210 6460784, info@eccgreece.gr.

The Customer may contact the above mentioned authority which will guide him/her through the process of filing and processing his complaint.

Lastly, we would like to underline the fact that the above mentioned protective clauses, as well as the legislation on Distance Contract Protection refers only to transactions performed by natural individuals, acting outside their trade, business, craft or profession.

Special conditions

1. Certain orders include special conditions (for example, in case of works reproduced on demand, works which are not readily available, works the preparation of which demand a longer period of time). In this case, the ‘Ikastikos Kiklos Sianti’ Gallery will contact the Customer in advance, informing him/her of the exact delivery time. The order will be processed only after the Customer’s express consent.
2. The ‘Ikastikos Kiklos Sianti’ Gallery offers you the opportunity to contact us via e-mail or by phone and have an item on hold for 48 hours, so that you may look at it or pay for it in person (in cash or by debit/credit card), after a prearranged meeting to our store at 2, Vas. Alexandrou Av., Athens 11634. T: 210 7245432, +30 210 3648335. The item will be automatically released after 48 hours.
3. The ‘Ikastikos Kiklos Sianti’ Gallery cannot guarantee the availability of the products displayed on its website. If the selected item is not readily available, the company is committed to informing the customer in due time.
4. The delivery deadlines as mentioned in the ‘Ikastikos Kiklos Sianti’ website are indicative and could be amended. In case of any delays, the ‘Ikastikos Kiklos Sianti’ Gallery will contact you via e-mail or by phone, in order to inform you of the exact delivery date.
5. Any printing, reproduction and/or distributing of the artworks and items displayed on the ‘Ikastikos Kiklos Sianti’ website, is strictly prohibited.
6. All items purchased through our e-shop are accompanied by a special document containing a picture of the item and its special features (i.e. date of creation, number of copies, artist-creator etc.).

DELIVERY POLICY

Shipments

GREECE ORDERS

Shipments within Attica and the rest of Greece (mainland and island destinations) are delivered within 7-10 business days.

Delivery costs are set to the amount of 7.00 Euros.

If you do not wish to pay through Pay Pal, credit/debit card or bank account, you can pay by Cash on Delivery (i.e. pay the full purchase amount to the courier upon the package’s delivery). The Cash on Delivery service is charged by the courier company for 2.00 euros per shipment.

You can also collect your order free of delivery costs, from our physical store at 2, Vas. Alexandrou Av. and Michalakopoulou Str. (Hilton area), ground floor, Athens 11634, Greece, during opening hours.

Purchases over 130.00 euros are free of delivery costs, regardless the method of payment.

INTERNATIONAL ORDERS

All international orders are shipped with ELTA COURIER, according to the special conditions, charges and agreements in effect.

The Cash on Delivery service is not available on international orders.

Non-EU customers may be subject to additional costs, according to the applicable exchange rates, customs clearances and import duties, restrictions and other local demands for which the Company bears no responsibility.

Delivery Insurance

The Company guarantees the quality, completeness and validity of the information shared on its website, as well as the accuracy of the products’ material features and the services provided by the Company through its e-shop. In the context of good faith, the Company bears no liability for any misprints or technical mistakes, which may have occurred unwittingly or due to technical problems affecting the website’s smooth operation due to force majeure.

The Company insures all items dealt through its website, from the moment of purchase until the moment of delivery to the customer.

In case the delivery falls through due to the courier’s fault, the Company could arrange a new delivery within 7-10 business days, free of extra charges.

All items displayed on the ‘Ikastikos Kiklos Sianti” website are delivered in a special, secured packaging to ensure its excellent condition. The Company bears no responsibility for any damages done to the packaging during delivery. If such is the case, please contact us in order to inspect the damage and arrange a replacement for your order.

The Company bears no liability for any failure of delivery due to force majeure. The Company is only responsible in cases of willful misconduct and gross negligence concerning the delayed delivery of goods, as well as the information and services provided through its website.

Items are shipped and delivered to the address indicated by the customer and it is the customer’s responsibility to provide correct and accurate address information. The Company bears no liability for any delivery failures due to false or incorrect address information. If the Customer unduly refuses to accept his/her order, redirecting it to the Company, he/she is the full bearer of any re-dispatching costs.

RETURN POLICY

Right of withdrawal

You have the right to withdraw from your purchase contract within 14 calendar days from the day of the order’s receipt, without having to announce the reason why. In order to have the right of withdrawal, you are obliged to inform us of your intention to withdraw from this contract, providing a clear statement within the above mentioned 14-day limit. In this case, the Customer bears the obligation of returning the product to the Company in the perfect condition, in which he/she received it. The Company will accept the return of the purchased item only on condition that it has not been used in any way, it is returned in the perfect state in which it was delivered, in its original packaging (box or otherwise), bearing no apparent damages or tears and including all its original components. Silk screens, in particular, are delivered in a special packaging, wrapped in a transparent gelatin which, if opened, excludes any possibility of the item’s return. You can fill in the withdrawal form you will find here. When the withdrawal form has been completed, you can either sent it to us via e-mail to return@ikastikos-kiklos.com , or you can include it to the returning package. In order for the return to be accepted, the package must be accompanied by the original receipt or invoice of purchase.

Consequences of withdrawal

Should you decide to withdraw from the purchase contract, you will be reimbursed with the full amount of your purchase after the items have been returned to us in perfect condition.

Any return costs, as well as any additional charges of your own choice (i.e. Cash on Delivery costs) will not be included to the delivery costs refund. The refund will be authorized within 14 days from the day we receive the returning items. The money will be refunded in the same way as it was received by the Company in the initial transaction.

Alternatively, you can avoid any return costs by delivering in person the purchased items to our store (Ikastikos Kiklos Sianti, 2 Vas. Alexadrou Ave. and Michalakopoulou Str., Hilton area, Athens 11634, Greece).

If one or more of the above terms are not met, the Company reserves the right to dismiss the withdrawal.

Intellectual Property Rights

This website and its intellectual content (i.e. photographs, names and trademarks, including HTML and other code contained in this website) are the intellectual and industrial property of our Company and are protected in accordance with the Greek legislation as provided in Law No. 2121/1993 on the Protection of Copyright and Related Rights, without prejudice to all rights not expressed here.

Users are strictly forbidden to transmit in any way internal and confidential information gained or revealed in the context of the trading relationship between the Company and the Customer, as well as any other information covered by confidentiality agreements or information violating patents, trademarks and confidential, intellectual or ownership rights of third parties.

The Company is in no event liable for any legal claims or for any damages which may result to users or to third parties from accessing this website’s services, options or content. The Company cannot guarantee that the external links contained in this website (as well as the hosts, proxies and servers which provide them) are free of viruses, malware and other harmful components. In any case, we recommend that all users make sure their systems are protected by a recently updated and reliable antivirus software.

Users are not permitted to overrun our website’s codes in any way, introducing possible malicious software, codes, files or programs which are designed to cause malfunctions or any other problems to computer software or hardware, either wittingly or unwittingly, since any such action violates the applicable Greek and EU Law and legislations.
